What lenders do when they find your record
Czech law obliges every provider of consumer credit to assess creditworthiness carefully, and registers are the first source they check. A recent default in SOLUS, BRKI or NRKI usually triggers automatic refusal at banks and at the larger licensed non-bank lenders.
Nothing forbids lending to someone with a register entry, but the lender must be satisfied that you can repay from your income without falling into hardship. Offers that ignore registers entirely therefore deserve suspicion, because a licensed provider cannot simply skip the assessment.
SOLUS, BRKI, NRKI and the public lists
SOLUS is an association of creditors, mainly telecoms, utilities and non-bank lenders, which shares payment defaults. BRKI gathers data from banks and NRKI from licensed non-bank providers, both operated by CBCB. Insolvency and the central register of enforcements are separate public records.
How long records are kept
Retention differs by register and is set by each operator under data-protection rules. Typically, negative information remains for several years after the debt is settled, in many cases up to around four years, while unpaid debts stay listed until resolved.
Obtaining an extract and correcting errors
Under the GDPR you may ask each register for the data it holds about you; written requests are generally answered free of charge, while instant online extracts carry a fee. Wrong or already paid entries should be contested with the creditor and the register operator.
Interest, fees and legal protection
Czechia has no single numerical interest cap for consumer loans. Instead, contracts contrary to good morals can be void, usury is a crime under the Criminal Code, and the 2016 Consumer Credit Act requires every non-bank lender to hold a Czech National Bank licence.
The RPSN, the annual percentage rate of charge, must appear in every offer and contract. Contractual penalties and late interest are restricted by law, and consumers can withdraw from a credit agreement within fourteen days. Complaints go to the central bank or the financial arbitrator.
Alternatives you can realistically use
None of these routes is automatic, but each has helped people in a similar position. The aim is to cover an essential need or stabilise finances, not to add another instalment that pushes the household closer to enforcement proceedings.
| Option | Where to ask | Conditions | Limits |
|---|---|---|---|
| Settlement and removal | Creditor, register operator | Pay or agree instalments, then request update | History may remain for years after payment |
| Free debt counselling | Accredited NGOs such as Člověk v tísni or Charita | Budget review, creditor negotiation, insolvency filing | Waiting times in some regions |
| Emergency state support | Labour Office | Mimořádná okamžitá pomoc for acute need | Means-tested, not a loan |
| Pawn loan | Licensed pawnshops | Item left as security, short term | High charges, item sold if unpaid |
| Guarantor or co-borrower | Banks and licensed lenders | Second person with clean record and income | That person bears the full risk |
| Debt relief | Insolvency court through accredited advisers | Regular income, repayment plan | Years of strict budgeting |
| Donation crowdfunding | Donio and similar platforms | Public appeal for a documented personal need | No guaranteed result, platform fees |
| Self-employment support | Labour Office, Národní rozvojová banka via banks | Contribution or advice for job seekers starting a business | Insurance advances due even in weak months |
Free debt advice and oddlužení
Accredited counselling services, including NGO advice centres and a Ministry of Justice supported free insolvency advice line, prepare budgets and negotiate with creditors. Where debts are unmanageable, they can file an oddlužení petition, which ends with remaining debts written off after the plan.
Family loans, employer advances and guarantors
A loan from relatives recorded in a simple written agreement with dates and amounts avoids misunderstandings. Some employers pay advances on wages. A guarantor makes approval more likely, but becomes fully liable and may face enforcement if payments stop.
Five practical solution families in Czechia
Czech banks and licensed non-bank providers rarely look past a negative register entry, so the realistic question is which channels assess the item, the project or the need instead. Five families are worth knowing, next to settling debts and accredited dluhové poradenství.
Pawn loans (zastavárny). Pawnshops operate with a trade licence and anti-money-laundering duties, and they lend against jewellery, electronics or tools without consulting SOLUS. The amount is a share of the estimated value, the term is short, and an unredeemed item is sold.
Microcredit and cooperative savings banks
Personal microcredit hardly exists in Czechia. A few credit cooperatives (družstevní záložny) still operate under Czech National Bank supervision, but they consult registers like banks. Small business finance from the Národní rozvojová banka flows through banks and suits people who already have a clean record.
Donation crowdfunding and community help
Platforms such as Donio collect gifts for individuals facing illness or sudden hardship, and Hithit funds creative projects through rewards. Consumer peer-to-peer lending has largely left the market, while business crowdfunding platforms need authorisation from the central bank under the EU regulation.
Charities and emergency support
Charita Česká republika, Armáda spásy and Diakonie run debt advice, food banks and shelters, while foundations such as Dobrý anděl support families with seriously ill children. These are gifts or services, not credit, so they never appear in SOLUS or the bank registers.
Practical plan
Each new application leaves a trace, and repeated refusals do not help. It is more effective to know exactly what the registers say, deal with the debts behind the entries, and only then approach a lender that can see a stable situation.
- Request your data from SOLUS, BRKI and NRKI and check public insolvency and enforcement records.
- Correct mistakes and debts already paid by writing to the creditor and operator.
- Book an appointment with an accredited free debt counselling service.
- Agree instalments or settlements and ask for confirmation once paid.
- For acute need, ask the Labour Office about emergency support.
- Borrow only from a lender licensed by the Czech National Bank, comparing RPSN and total cost.
Rebuilding your payment history
Positive records in BRKI and NRKI show regular payments. Once old defaults are settled, a small loan or card used carefully and repaid on time, together with punctual phone and energy bills, gradually improves how lenders judge your file.
Red flags in offers for people in registers
Advertisements for půjčky bez registru from private individuals appear daily on social networks. Many are run by fraudsters who demand an advance before payout, or by unlicensed lenders who secure small loans with a flat or house through a notarial deed.
- A request to pay processing, insurance or notary fees before the money arrives.
- Offers from abroad or via messaging apps without a CNB licence number.
- Blank bills of exchange or property pledges for a small consumer loan.
- Promises to delete register entries for a fee.
- Pressure to sign immediately without reading the contract.
When another loan makes things worse
If debts are already with bailiffs, a new loan rarely helps and may be seized at once. Debt counselling, social benefits and possibly oddlužení protect the household better than credit taken to repay older credit at higher cost.
Can I get a loan with a SOLUS entry?
Some licensed lenders accept an older or small SOLUS record if income is stable and the debt has been paid. Recent defaults with banks or non-bank lenders are judged more strictly. A guarantor or collateral can tip the decision.
How do I get removed from SOLUS?
Pay the debt and ask the creditor to update the record. Depending on the register, the negative entry is then marked as settled and kept for a defined period before deletion. Incorrect entries must be removed once proven wrong.
Can self-employment help me leave the debt spiral?
It can, if the activity earns steadily. Registered job seekers may ask the Labour Office about a contribution toward a self-employed position. Be aware that social and health insurance advances are due every month, and income from a business can still be seized in exekuce.
Does oddlužení remove me from registers?
After successful debt relief, remaining debts are discharged and the insolvency record is eventually removed, but registers may still show the history for some time. Rebuilding usually takes several years of reliable payments on every bill.
